Consumer Says Insel Air Breached Contracts with Passengers with 'Exit Fees'

A proposed class action claims Insel Air and Insel Air Aruba N.C. breached their contracts with passengers by charging undisclosed 'exit fees' for certain flights.
A proposed class action claims Insel Air and Insel Air Aruba N.C. breached their contracts with passengers who booked flights between Miami and Venezuela and, separately, between Miami and Aruba.
The plaintiff alleges that although the taxes and fees contained within the Contract of Carriage Insel Air has with its passengers are subject to change up to the time of purchase, some passengers departing Miami were informed they would need to pay an undisclosed “Exit Tax.” This tax, the lawsuit argues, is not mentioned anywhere on the defendants’ website.
“Despite the clear terms of its contract and the full payment of the tickets, the Airline conducted a program in which its ticket-holding travelers were required to pay additional, extra-contractual Exit Fees at their sole U.S. departure airport, Miami International Airport, before being allowed to board their flights,” the lawsuit alleges. “The Airline already had the undisclosed Exit Fee program in place at the time the Airline entered into a contractual agreement with its passengers.”
The complaint notes the ostensible exit fee cost passengers an extra $80 on top of the cost of their tickets.
