A proposed class action filed in Georgia alleges Orange Tree Employment Screening LLC and Launch Technical Workforce Solutions, LLC together violated the Fair Credit Reporting Act (FCRA). The plaintiff claims Orange Tree Employment Screen erred by publishing “inaccurate, incomplete and not up-to-date” consumer report information while conducting a pre-employment background check.
“Specifically, Orange Tree associated [the plaintiff] with multiple criminal records that did not belong to him and, as a result, [he] was denied a job and suffered other damages,” the complaint alleges.
Launch Technical Workforce Solutions is alleged to have taken adverse employment action against the plaintiff based on the ostensibly erroneous background report information it was provided by Orange Tree. According to the complaint, Launch Technical Workforce Solutions revoked its conditional offer of employment (for an aircraft maintenance job) to the plaintiff without first providing the man with a reasonable opportunity to review and respond to the information in his background report.
