NCB Management Services Inc. is the defendant in a proposed class action lawsuit filed by a New York man who claims the debt collector failed to clearly communicate the amount of his alleged debt. The plaintiff says NCB sent him a debt collection letter that included a “Balance” but did not indicate whether his alleged debt would increase due to interest or fees. According to the suit, the “Balance” was, in fact, increasing, but the plaintiff was “left uncertain” of the interest rate and how much money would still be owed if the balance in the letter were paid. The complaint argues that the unsophisticated consumer could not be confident that any payment he or she made would settle the alleged debt and discontinue the defendant’s collection efforts.
