Vital Recovery Services, LLC is the defendant in a Wisconsin consumer’s proposed class action filed over alleged Fair Debt Collection Practices Act (FDCPA) abuses. The plaintiff argues a debt collection notice he received from the defendant was “false, misleading, contradictory and confusing” because, although it identifies the creditor in one place as “LendingClub Corporation,” it mentions that the man’s account is held by “LendingClub Corporation & LC Trust I” in another spot in the same communication. The lawsuit claims that such conduct in a collection notice is a violation of the FDCPA because it could lead the unsophisticated the consumer—the benchmark used by courts to gauge the legality of debt collectors’ practices—to be unsure of exactly which party holds his or her debt, as well as to whom payment should be made.
