Chavez v. Systems & Services Technologies, Inc.
Filed: February 28, 2018 ◆§ 3:18cv446
Systems & Services Technologies allegedly failed to inform a consumer of the 30-day window in which the validity of the debt could be disputed.
California
A California consumer claims in a proposed class action that defendant Systems & Services Technologies, Inc. mailed a demand notice in October 2017 that unlawfully neglected to relay the plaintiff’s debt validation rights under the Fair Debt Collection Practices Act (FDCPA). More specifically, the complaint says, Systems & Services Technologies did not inform the plaintiff of the 30-day window in which the validity of the debt could be disputed, after which the company would have to obtain verification.
The complaint later charges that the defendant erred in failing to provide the plaintiff with a “mini-Miranda” warning—notice that it was a debt collector calling in an attempt to collect a debt—when it called the individual’s phone last October.
