A New York consumer has filed suit against Simple Mills Inc. over claims that the defendant’s Almond Flour Crackers and Sprouted Seed Crackers also contain flours derived from sources other than almonds and sprouted seeds.
A New York consumer has filed suit against Simple Mills Inc. over claims that the defendant’s Almond Flour Crackers and Sprouted Seed Crackers also contain flours derived from sources other than almonds and sprouted seeds.
The case argues that the Almond Flour Crackers label misrepresents to consumers that the product is made with only almond flour when the ingredients list notes that the crackers contain a flour blend of almonds, sunflower seeds, and flax seeds. Similarly, the suit alleges, the Sprouted Seed Crackers are made with ingredients other than just sprouted seeds, contrary to the representations on the front of the package.
The suit argues that a reasonable consumer would not expect the products to contain other types of flour besides what was represented on the packaging and therefore paid a premium price for products that allegedly failed to live up to their claims.
