A Florida woman claims the debt collector continually contacted her looking for an unknown individual named 'Larry' in an attempt to collect on a debt.

In a proposed class action case, a Florida woman alleges debt collector Receivables Performance Management, LLC routinely places automatically dialed robocalls to consumers’ cell phones without express consent to do so. Citing possible violations of both the Telephone Consumer Protection Act (TCPA) and Fair Debt Collection Practices Act (FDCPA), the plaintiff claims the defendant began automatically calling her cell phone in September 2017 looking for an unknown third party named “Larry,” with the intent of attempting to collect a defaulted debt. According to the complaint, the plaintiff received multiple calls per day throughout September and October 2017 over the same debt supposedly owed by this unknown “Larry.” The plaintiff claims Receivables Performance Management continued to call her cell phone, allegedly using a prohibited automated dialer, even after informing the company she was not and did not know Larry.
