In a lawsuit, a Georgia woman says Receivable Management Group failed to properly specify the current creditor to whom her debt was owed.

A Georgia woman alleges in a proposed class action that defendant Receivable Management Group mailed her an initial collection notice in which it failed to explicitly or implicitly identify her current creditor. The lawsuit alleges the collection notice in question merely stated “RE: Emerginet ER Physicians Henry” without explicitly conveying that the entity is in fact the plaintiff’s current creditor.
“The obligation is not only to identify the name of the creditor, but to convey the name of the creditor clearly and explicitly,” the lawsuit argues. “Merely listing ‘RE: Emerginet ER Physicians Henry’ on a collection letter does not explicitly convey that ‘Emerginet ER Physicians Henry’ is the current creditor to whom the debt is owed.”
