MRS BPO, LLC is on the receiving end of a proposed class action lawsuit that takes issue with an allegedly unlawful letter sent by the collection agency.
The plaintiff alleges that he received the notice in September 2017 and that it contained false implications with regard to future creditworthiness should he settle the obligation rather than repay it in full. The letter stated, in part:
“If we settle this debt with you for less than the full outstanding balance, Chase may offer you less favorable terms in the future for some Chase products or services, or may deny your application.”
The case argues this statement falsely implied that paying the debt in full, rather than taking a settlement, “would have enhanced [the plaintiff’s] likelihood of receiving future credit products or enhanced her overall creditworthiness.”
