Consumer Claims Kanoa Marketed Wireless Ear Buds It Never Intended on Selling

A California man claims he and many others preordered Kanoa's wireless earbuds and were never reimbursed after the company ceased development.
A proposed class action filed in California seeks to stop Kanoa Inc. and its CEO’s alleged practice of falsely advertising the sale of Bluetooth-enabled earbud headphones the plaintiff claims the parties had no intention to actually distribute to proposed class members. According to the case, the plaintiff and similarly situated individuals pre-ordered the defendants’ product for $149.43 in February 2016 only to learn months later the parties ceased development of the earbuds entirely. The plaintiff says the defendants have made no attempt to refund money to proposed class members.
Per the supposed timeline of events, the case says the defendants made their product available for pre-order through their website in February 2016, informing consumers the earbuds would be shipped around April 2016. Proposed class members were then allegedly notified that the shipping date would be pushed back to Summer 2017. In August, the lawsuit continues, the defendants, through a statement on their website, said development of the earbuds had ceased and that no money would be refunded.
