Consumer Claims Genpact Services Left Important Information Out of Collection Letter

Matrakas v. Genpact Services Llc
Filed: December 4, 2017 ◆§ 2:17cv7034
Genpact Services faces a case in which the plaintiff claims the company failed to disclose in a collection notice the minimum debt payment due.
A New York consumer alleges in a proposed class action that defendant Genpact Services LLC unlawfully failed to note in a collection notice the minimum amount of payment owed at the time the letter was sent. Citing possible Fair Debt Collection Practices Act (FDCPA) abuses, the lawsuit charges Genpact failed to provide the plaintiff with information that would allow the “least sophisticated consumer” to determine what needs to be paid to resolve the debt at any given time in the future. Moreover, the lawsuit takes issue with the defendant’s supposed failure to indicate in the notice the applicable interest rate, date of accrual of interest, and the amounts and nature of any “other charges” owed.
“The Letter, because of the aforementioned failures, would render the least sophisticated consumer unable to determine the amount of his or her debt,” the case reads.
