Russell v. Forster & Garbus, LLP et al
Filed: July 18, 2017 ◆§ 2:17-cv-04274
Forster & Garbus, LLP, LVNV Funding LLC, Sherman Financial Group, LLC, and two individuals are defendants in a proposed class action lawsuit that claims they illegally commenced litigation against the plaintiff over an allegedly unpaid debt.
New York
Forster & Garbus, LLP, LVNV Funding LLC, Sherman Financial Group, LLC, and two individuals have been named as defendants in a proposed class action lawsuit that claims they sued the plaintiff over an allegedly unpaid debt when they “had no standing or legal right” to do so. The complaint alleges that the debt collectors failed to provide proof that the plaintiff was the true owner of the debt and that Forster & Garbus “did not fulfill its legal obligation to conduct a meaningful attorney review” before filing a lawsuit against the plaintiff. According to the suit, the defendant’s conduct is considered “an unfair and unconscionable means to collect or attempt to collect a debt” and violates the Fair Debt Collection Practices Act.
