De Ville Asset Management Limited Partnership is the defendant in a proposed class action lawsuit alleging the debt collector misled a Wisconsin woman as to the identity of her alleged creditor. The plaintiff says the defendant sent her two debt collection letters that stated “Re: Spartan – Tulsa” and also informed her that her account was “assigned to DeVille Asset Management, LTD.”
“The unsophisticated consumer,” the complaint reads, “would be unable to determine whether DeVille actually purchased the account or had merely been assigned the account for collection.”
The suit argues that upon reading the letters, the plaintiff would be unsure as to whom she owed the alleged debt.
