Bryan v. Credit Control, Llc
Filed: February 8, 2018 ◆§ 2:18cv865
Credit Control mailed a consumer a notice in which the company failed to identify the man's current creditor or the debt's owner, a lawsuit alleges.
A New York consumer alleges in a proposed class action case that defendant Credit Control, LLC mailed him a notice in which it failed to identify his current creditor or the owner of the debt. According to the lawsuit, Credit Control mailed the plaintiff a notice in February 2017 that stated “our client” as Kohl’s Department Stores, Inc., with the original credit grantor being Chase Bank USA N.A. The case then points out that Kohl’s issues private-brand credit cards that, since 2011, have been issued and serviced by Capital One Bank.
“The current creditor or owner could be Capital One Bank or Kohl’s Department Stores,” the lawsuit reads. “It is not possible to determine from the letter.”
