A Wisconsin consumer has filed a proposed class action lawsuit against Credit Collection Services, Inc. claiming the debt collector illegally imposed additional requirements on consumers attempting to dispute their purported debts.

A Wisconsin consumer has filed a proposed class action lawsuit against Credit Collection Services, Inc. claiming the debt collector illegally imposed additional requirements on consumers attempting to dispute their purported debts. The defendant allegedly sent the plaintiff a collection letter instructing her to include a copy of the letter with any written correspondence, which the complaint says would include disputes. The suit argues that this requirement “imposes an additional burden” on the consumer and overshadows the included notice regarding the debt dispute process.
“The purpose of the statement indicating that the consumer is required to attach a copy of the debt collection letter is to discourage consumers from exercising their dispute rights,” the complaint reads, adding that many consumers do not have access to a photocopier in their homes and would be hesitant to copy a debt collection letter at work or in a public setting.
