A class action filed in late Sept. claims Central Credit Services mailed a collection notice in which it failed to say whether the balance may increase.

A proposed class action filed on September 28 against Central Credit Services LLC claims the company mailed the plaintiff a collection notice in which it unlawfully failed to disclose whether the man’s balance may increase due to accruing interest and fees. The complaint argues the defendant’s November 2016 notice was confusing and likely to be misinterpreted by the “least sophisticated consumer,” i.e., the plaintiff. When a debtor’s current balance is increasing as a result of interest, the case says, the Fair Debt Collection Practices Act (FDCPA) requires debt collectors to disclose that the amount of debt stated in a letter “could” or “will” increase over time.
