ARS National Services, Inc. is the defendant in a proposed class action lawsuit alleging violations of the Fair Debt Collection Practices Act (FDCPA). The plaintiff claims she received a debt collection letter from ARS that stated her alleged “balance” but failed to indicate whether the balance would increase due to interest or late fees. She further argues that the defendant neglected to clearly identify her supposed creditor. According to the suit, debt collectors have an obligation to clearly state the amount of debt and the creditor to whom the debt is due, as required under the FDCPA. The complaint claims that ARS “failed to clearly, explicitly and unambiguously convey” the information it was required to disclose.
