A WI consumer claims Allied International Credit Corp. erred in failing to clearly state the entity to whom payment on the debt is owed.

Allied International Credit Corp. is the defendant in a proposed class action filed by a Wisconsin consumer who claims the company failed to clearly identify in a collection notice the name of the creditor to whom payment is owed. The complaint sticks on the following language allegedly included in the collection notice:
“The above referenced account has been referred to our office for collection. Our client’s previous attempts to resolve this debt have proven unsuccessful.”
The lawsuit claims the defendant violated the Fair Debt Collection Practices Act (FDCPA) by failing to state the actual owner of the plaintiff’s debt. Though eBay is named in the notice, the lawsuit argues the defendant erred in not explicitly stating the online auction site as “the creditor to whom the debt is owed.”
