A New York resident claims in a proposed class action that defendant Constar Financial Services, LLC engaged in numerous abuses of the Fair Debt Collection Practices Act (FDCPA). The plaintiff alleges that in a February 28, 2017 collection notice, the defendant unlawfully failed to disclose whether his $2,862 account balance may increase due to accrued interest or fees. Additionally, the defendant’s notice in question allegedly failed to note on what date the “total due” was calculated.
