A class action out of Wisconsin claims Constar Financial Services, LLC violated the Fair Debt Collection Practices Act (FDCPA) by sending the plaintiff a collection letter stating it holds a Wisconsin Collection Agency License when such a statement is not true. According to the complaint, the defendant is not licensed by the Wisconsin Office of the Administrator of the Division of Banking or any other state governmental agency even though it has misrepresented itself as so in collection letters. Making materially false statements is a violation of the FDCPA because it may confuse the unsophisticated consumer.
