Conrad Credit Corporation is facing a proposed class action over an allegedly deceptive collection letter containing illegal "threats".
Conrad Credit Corporation is facing a proposed class action over an allegedly deceptive collection letter. According to the lawsuit, the letter contained the following statement:
“Your balance may periodically increase due to the addition of accrued interest in the agreement with the creditor or as provided [b]y law.”
The case argues that the defendant was aware that the debt balance would not increase due to interest and that saying otherwise was a deceptive collection tactic that violated the Fair Debt Collection Practices Act. The lawsuit further alleges that this statement unlawfully misled the plaintiff regarding his right to dispute the debt as he was under the impression that immediate payment was required to avoid a balance increase.
