A Pennsylvania woman alleges in a proposed class action that the complimentary transportation services offered at defendant Concord Hospitality Enterprises Company’s hotels are discriminatory toward guests with disabilities. Citing possible Americans with Disabilities Act (ADA) violations, the plaintiff—identified in the complaint as a “tester,” a former board member of Disability Options Network, and a member of disability rights group ADAPT—claims she was informed by an agent at one of the defendant’s locations in Pittsburgh that the company’s shuttle service could not accommodate wheelchairs. According to the lawsuit, investigation performed on the plaintiff’s behalf found that a “substantial number” of the defendant’s hotels nationwide offer transportation services to guests, but do not offer equivalent services to individuals who use wheelchairs or scooters.
The complaint alleges at least 12 of the defendant’s hotels across New York, Pennsylvania, and Texas fail to offer ADA-compliant transportation services.
