A proposed class action filed against Compliance Educators, LLC, DOT Compliance Group, LLC, and the companies’ owner claims the parties illegally sent text messages to consumers’ cell phones in violation of the Telephone Consumer Protection Act (TCPA). The case takes issue with the defendants’ bulk marketing strategy in which it allegedly sent truckers, such as the plaintiff, unsolicited text message advertisements via a prohibited automatic telephone dialing system. The defendants allegedly continued their intrusive marketing practices despite a barrage of complaints and an “F” rating from the Better Business Bureau.
