Murphy v. HF Holdings, Inc et al
Filed: December 27, 2017 ◆§ 2:17cv7537
A NY consumer claims he received notices from HF Holdings seeking $20 on behalf of Mineola Medical Lab despite having no prior business with the company.
New York
A proposed class action has been filed in New York against HF Holdings, Inc., its owner, and Mineola Medical Lab, LLC in which the plaintiff claims the parties violated federal law in attempting to collect on a debt supposedly owed for a medical test.
Noting that defendant HF Holdings has reportedly “been sued numerous times” for allegedly violating the Fair Debt Collection Practices Act (FDCPA), the complaint claims the plaintiff received two notices from HF seeking to collect $20 on behalf of Mineola Medical Lab even though the man had no prior business with the company nor agreed to pay money for any of its services. The lawsuit claims both notices:
- Falsely threatened the plaintiff with a lawsuit;
- Falsely indicated interest was accruing;
- Failed to explain what interest was accruing;
- Failed to properly indicate the amount of debt; and
- Falsely pinned attorneys’ fees and court costs for collecting the debt onto the plaintiff.
The case adds that the notices also presented threats to report the plaintiff to credit reporting firms while indicating non-payment would damage his credit score. According to the complaint, Mineola Medical Lab is responsible for hundreds of similar notices sent to consumers that falsely claim they owed debts.
