The food and support services provider allegedly failed to make mandatory disclosures regarding its intention to procure the plaintiff's background report.
Compass Group USA, Inc. is on the receiving end of a proposed class action in which the plaintiff alleges the food and support services company failed to follow the Fair Credit Reporting Act’s (FCRA) disclosure regulations. The plaintiff claims Compass Group USA overstepped federal law by procuring consumer background reports for employment purposes without first disclosing to current or potential employees in a standalone document that the company may obtain a consumer report for employment purposes.
“[The defendant] willfully violated this requirement by failing to provide [the plaintiff] with a copy of a document that consists solely of the disclosure that it may obtain a consumer report on her for employment purposes, prior to obtaining a copy of her consumer report,” the case states.
Per the plaintiff, the lawsuit says the woman applied for a job with the defendant around April 2016 and was subject to a background check. The woman claims she was distracted by the presence of additional information in the supposed FCRA disclosure she was provided by the defendant.
