A proposed class action filed in California claims 321 West Katella, LLC and Saloon Anaheim, which do business as McFadden’s Restaurant and McFadden’s Anaheim, respectively, violated federal law by sending out “blasts” of unsolicited junk fax messages that did not contain mandatory opt-out language. The lawsuit, citing possible Telephone Consumer Protection Act (TCPA) violations, claims the nuisance fax messages were sent as part of a well-organized advertising campaign.
