The 12-page lawsuit says that by failing to honor requests to opt out of receiving text messages, the grant and scholarship finder has run afoul of the Telephone Consumer Protection Act, which is designed to safeguard consumers from unwanted telemarketing solicitations.
As the suit tells it, Scholly has continued to send promotional messages to consumers even after they have opted out, which demonstrates the company’s apparent failure to maintain an in-house do-not-call list. The case charges that Scholly similarly lacks a written policy with regard to telemarketing procedures and has failed to provide sufficient training to marketing staff.
Even though the plaintiff requested many times that the company stop texting him, Scholly continued to send messages to the man’s cell phone, the complaint describes. This “invasion of privacy” has likely disturbed the “daily life of thousands of individuals,” the filing claims.
The lawsuit looks to represent anyone in the United States who, since May 3, 2019, received to their residential phone numbers a promotional text message from Scholly, Inc. after making a request to stop receiving texts.
