Wisconsin debt collection group Collection Associates, Ltd. is the defendant in a proposed class action claiming sent the plaintiff a notice that attempted to collect an unauthorized debt amount. The plaintiff claims she received two collection notices from the defendants, the balance on the second letter $29.17 higher than that of the first. The lawsuit alleges the defendant violated the Fair Debt Collection Practices Act (FDCPA) by failing to include a validation notice in its attempt to collect this additional new debt. Without this vailidation language, the case argues, the consumer may not be aware of his or her right to request and receive validation of a debt amount.
