A class action lawsuit has been filed against ARS National Services, Inc. over its allegedly abusive and deceptive debt collection practices. Filed in New York, the lawsuit claims the defendant violated the Fair Debt Collection Practices Act (FDCPA) by sending a collection letter to the plaintiff regarding a credit card debt that did not specify whether interest and late fees were continuing to accrue. This omission, the suit claims, left the “unsophisticated consumer” in the dark as to the exact amount of debt owed, a violation of the FDCPA.
The proposed class includes consumers in New York who received a debt collection letter for an amount owed to Chase Bank that did not specify if the aforementioned fees were continually accruing.
