A proposed class action alleges defendants Cole Capital Corporation, Cole Credit Property Trust IV, Inc., and Cole Credit Property Trust V, Inc. committed violations of Title III of the Americans with Disabilities Act (ADA) at their Gibsonia, Pittsburgh, and Meadville (Pennsylvania) facilities. Filed by three wheelchair-bound named plaintiffs with mobility disabilities, the lawsuit alleges the plaintiffs and proposed class members were denied full and equal access to the defendants’ facilities as a result of inaccessible parking lots and paths of travel. The case seeks injunctive relief.
According to the complaint, the plaintiffs experienced “unnecessary difficulty and risk” in accessing the defendants’ facilities because of the excessive slopes and inadequate access aisles in the companies’ parking lots.
