Coca-Cola Facing Suit Over Gold Peak Tea’s ‘No Preservatives’ Claim

Coca-Cola is the defendant in a class action lawsuit claiming its Gold Peak Tea products, contrary to ad claims, contain artificial preservatives.

A proposed class action filed in New York against The Coca-Cola Company and Coca-Cola Refreshments USA, Inc. claims they deceptively market the following Gold Peak Tea products:
- Gold Peak Diet Tea
- Gold Peak Lemon Tea
- Gold Peak Unsweetened Tea
- Gold Peak Sweet Tea
- Gold Peak Green Tea
The 24-page complaint alleges the above products, despite the defendants’ claims that they contain no preservatives, contain citric acid, phosphoric acid, and ascorbic acid, which the lawsuit describes as “well-known preservatives commonly used in commercial food and drink products.” The plaintiff, a New York man, argues Coca-Cola’s position and representation of its Gold Peak Tea products capitalized on consumers’ preference for beverages without preservatives, and violate New York state consumer protection laws.
