The 12-page lawsuit says that the company, which owns and operates numerous transportation services, has violated Illinois’ Biometric Information Privacy Act (BIPA) by requiring workers to scan their fingerprints for timekeeping purposes without first obtaining their express written authorization to collect, store and disseminate their biometric information. The suit also accuses Coach USA of failing to disclose how long and for what purpose the biometric data would be kept and when it would be destroyed—information that the BIPA requires companies to disclose prior to their collection of consumers’ biometric data.
Per the case, Coach employees are required to scan their fingerprints—considered a biometric identifier under the BIPA—on the company’s biometric-enabled devices in order to clock in and out of shifts. The complaint explains that the devices store the data and allow Coach USA to transmit it to third parties for purposes such as payroll and data storage.
The plaintiff, an Illinois resident and Coach USA employee from 2017 to 2018, routinely scanned her fingerprints when punching in and out of work, the filing says. However, at no point did the woman provide the company with consent to capture, store and share her biometric data with third parties, nor was she ever informed through a written policy why or for how long the defendant would keep the information, or if it would be permanently destroyed, the suit claims.
The lawsuit looks to represent anyone whose biometric information was collected, stored and/or disseminated by or on behalf of Coach USA, Inc. within the state of Illinois at any time during the applicable statute of limitations period.
