A couple from Colorado claim Progressive Insurance refused to pay statutorily mandated fees after a 2016 total-loss car accident.
A husband and wife from Colorado have filed a proposed class action lawsuit that alleges Progressive Direct Insurance Company does not hold up its end of the bargain in the event of total-loss car accidents. The plaintiffs, whose Ford Fiesta hatchback was insured by the defendant for the 2016 calendar year, take issue with Progressive’s alleged practice of failing to pay auto insurance policyholders certain “statutorily mandated fees” after an accident or other event that results in total loss determination for the insured vehicle. The alleged unpaid fees, the lawsuit claims, include title and registration fees, which under Colorado law, should be included in total-loss calculations.
