A New York man has filed suit against Client Services, Inc. over claims that the defendant violated provisions of the Fair Debt Collection Practices Act (FDCPA) in a collection letter it sent him.
A New York man has filed suit against Client Services, Inc. over claims that the defendant violated provisions of the Fair Debt Collection Practices Act (FDCPA) in a collection letter it sent him. The letter allegedly contained the plaintiff’s “BALANCE DUE,” but failed to inform him that the amount was continually increasing due to interest.
Furthermore, the defendant noted in the letter that the man could settle his account to prevent “potential legal action,” according to the complaint. The suit argues that this language unlawfully threatened the plaintiff with an action the debt collector had no intention to take.
