A proposed class action has been filed against ClickSpark, LLC over alleged Telephone Consumer Protection Act (TCPA) violations.
A proposed class action has been filed against ClickSpark, LLC over alleged Telephone Consumer Protection Act (TCPA) violations. Two California women have put their names on the suit, which claims the defendant used automated dialing technology to place telemarketing calls to consumers' cell phones without their prior consent. According to the complaint, both plaintiffs informed ClickSpark that they were not interested in its services and demanded that the company stop calling them, but their requests were supposedly ignored.
“By making the telephone calls at issue in this Complaint,” the suit reads, “[the defendant] caused [the plaintiffs] actual harm, including the aggravation, nuisance, and invasion of privacy that necessarily accompanies the receipt of unsolicited and harassing telephone calls, as well as the monies paid to [their] carrier(s) for the receipt of such telephone calls.”
