Schleifer v. Etison LLC
Filed: November 12, 2017 ◆§ 1:17-cv-08792-JMF
Etison LLC (which does business as ClickFunnels) is facing a proposed class action lawsuit alleging it sent consumers text messages advertisements without their prior consent.
Etison LLC (which does business as ClickFunnels) is facing a proposed class action lawsuit alleging violations of the Telephone Consumer Protection Act (TCPA). The plaintiff in the case says he received several text messages from the defendant despite never providing his consent or engaging in a prior relationship with the company. According to the suit, the texts informed him that his card had “failed a payment” on ClickFunnels and instructed him to contact the company to “keep [his] account active.” The complaint argues that the unsolicited texts were sent using an automated dialing system and were illegal under the TCPA.
