Suarez v. Ralph, Paco & Roberto, Inc. et al
Filed: December 15, 2017 ◆§ 7:17cv9847
A New York consumer has filed suit against Ralph, Paco & Roberto, Inc. and Honky Tots, Inc. over claims that the defendants’ California Baby brand products are mislabeled as 'Natural' despite containing synthetic ingredients.
A New York consumer has filed suit against Ralph, Paco & Roberto, Inc. and Honky Tots, Inc. over claims that the defendants’ California Baby brand products are mislabeled as “Natural” despite containing synthetic ingredients. The 72-page complaint names more than 30 products the plaintiff alleges are falsely labeled, arguing that a reasonable consumer would never expect synthetic ingredients to be included in a product marked as “Natural” or containing “Natural Cleansers.” Among the ingredients in question are lauryl glucoside, panthenol, decyl glucoside, and tocopherol, which the suit says is an ingredient used in pesticides.
The plaintiff argues that she and proposed class members purchased the defendants’ products based on their labels’ false representations and were tricked into paying for items that were worth less than what they paid for them.
