Select Portfolio Servicing, a mortgage servicer, is the defendant in a class action lawsuit claiming the company violated the Fair Credit Reporting Act (FCRA). According to the complaint, the defendant impermissibly accessed the plaintiff’s consumer credit report on four different occasions even though no debtor-creditor relationship existed between the parties. The plaintiff, the suit says, filed a Chapter 13 personal bankruptcy action, thereby terminating the debtor-creditor relationship that existed in connection with a Las Vegas residential property. Under the FCRA, a consumer report cannot be used or obtained for any reason unless authorized by the consumer.
