California and Massachusetts consumers have filed a proposed class action against Mylan claiming the company illegally raised the EpiPen's price by more than 500 percent.
California and Massachusetts consumers have filed a proposed class action against Mylan claiming the company used its position as the only manufacturer of the EpiPen to illegally raise the price of the product by more than 500 percent since 2007. Plaintiffs are seeking to recover monetary damages related to overpayments for the hand-held emergency anaphylactic shock treatment. According to case documents, the EpiPen—which retails for around $600 and is often not covered by consumers’ insurance plans—comes in packs of two and can expire, meaning it must be replaced annually. Thanks to the company’s “extensive marketing, lobbying and branding efforts between 2007 and 2015,” plaintiffs claim Mylan’s practice of continually raising the price of the EpiPen—as well as switching to only selling it in “2-Paks” as opposed to single pens—has made it unaffordable for consumers who rely on it.
