A new class action out of Wisconsin claims Alltran Financial, LP, known as J.C. Christensen and Associates, Inc., violated the Fair Debt Collection Practices Act (FDCPA).
A new class action out of Wisconsin claims Alltran Financial, LP, known as J.C. Christensen and Associates, Inc., violated the Fair Debt Collection Practices Act (FDCPA) by fraudulently claiming in a collection letter that the company was licensed by the Division of Banking in the Wisconsin Department of Financial Institutions.
The plaintiff notes that her ex-husband was sued in 2014 by an unaffiliated party over a debt owed to American General Finance. The judgment was handed down against the plaintiff’s ex-husband only. Despite this, the lawsuit claims, the defendant unlawfully sent a collection letter to the plaintiff even though she had nothing to do with the judgment against her ex-husband.
In that erroneously sent collection letter, the defendant untruthfully claimed it was licensed by Wisconsin’s Division of Banking, a deceptive statement that violates the FDCPA, the suit claims.
