Class Action Says Festival-Goers Are Owed Unspent Digital Wristband Money

Intellitix and Intellipay are facing a lawsuit alleging they failed to refund unspent money on concert festival goers pre-paid electronic wristbands.
A proposed class action filed on behalf of music festival attendees in California and New York alleges some festival goers are owed unspent money pre-loaded onto defendants Intellitix, Inc. and Intellipay, Inc.’s radiofrequency identification (RFID) wristbands.
According to the lawsuit, RFID wristbands act as a “digital wallet” and a convenient cashless way for festival goers to pay for goods and services at events. Not only is this technology meant to make the festival experience more convenient for the attendee, the lawsuit notes, it also acts as a way to cut down on long lines and increase “spend” for vendors.
The defendants allegedly failed to refund to proposed class members unused funds that were pre-loaded via debit cards onto their RFID wristbands. Moreover, when the defendants did refund proposed class members’ money, the companies allegedly tacked on an (unlawfully) undisclosed $5 processing fee, the lawsuit asserts. The complaint then mention’s the defendants’ website, which reportedly notes the specific manner way post-event refunds will be provided to festival goers.
