A class action lawsuit claims CWS Apartment Homes violated the terms of the Telephone Consumer Protection Act (TCPA) by using automated dialing equipment to send text messages without the recipients’ prior express written consent. Filed in Pennsylvania, the lawsuit alleges the defendant sent unsolicited telemarketing text messages advertising apartment openings to the plaintiff’s cell phone.
The proposed class includes anyone within the U.S. who received a phone call or text message from the defendant placed or sent with an automated dialing system within the last four years.
