Bank of America is the defendant in a proposed class action claiming the company violated the Fair Credit Reporting Act (FCRA).
Bank of America is the defendant in a proposed class action claiming the company violated the Fair Credit Reporting Act (FCRA) by making an unlawful and unauthorized inquiry into the plaintiff’s credit. The lawsuit alleges the defendant, which had no pre-existing business relationship with the plaintiff, accessed her Trans Union credit report without authorization. The defendant claimed its reason for doing so was that it “had a legitimate business need for the information.” According to the case, the FCRA prohibits financial institutions from pulling consumer credit reports without consent.
