A proposed class action has been filed in New York against MJS America LLC, which operates as Majans America LLC and makes and sells snacks under the Majans Bhuja Snacks brand name. The lawsuit centers on the defendant’s “Ancient Grains Twists” product, and takes issue, in particular, with whether the product’s main ingredients—namely rice and peas—are even “ancient grains” at all:
“As commonly consumed and understood, rice and peas are not ancient grains. Modern-day rice is produced through milling, which removes the hucks, bran layer and germ to produce a white rice kernel. Peas are neither grains nor cereals, but legumes, from the plant family Fabaceae.”
The plaintiff argues that the labeling of the defendant’s product (below) is deceptive because it lists rice and peas, rather than actual ancient grains, such as chia and quinoa, as its most substantive ingredients.
