Swigart v. Parcel Pending, Inc.
Filed: September 26, 2018 ◆§ 3:18cv2238
Parcel Pending faces a lawsuit alleging the company recorded a phone call with a consumer without his consent.
Parcel Pending is the defendant in a proposed class action lawsuit filed by a California consumer who claims his sensitive phone call with the company was unlawfully recorded without his permission.
According to the case, the plaintiff spoke to a Parcel Pending representative in a July 2018 phone call regarding his personal property. At the end of the “highly personal” call, the case continues, the plaintiff was “shocked” to learn that the communication was recorded, given that he “had no reasonable expectation” that the call would be taped and never authorized the defendant to do so. The suit argues the call was in violation of section 632.7 of the California Penal Code, which prohibits the recording of communications without the consent of all parties.
