According to the eight-page lawsuit, there exists an overwhelming amount of scientific evidence showing that Nordic Naturals’ fish oil supplements are unable to provide consumers “Cognitive Clarity,” “Memory Function,” and “Neurological Health” as advertised. In fact, recent clinical research found that the products merely contain sardine and anchovy oil, which Harvard Professor Pieter Cohen says have “virtually no benefits for your average, healthy person,” the case relays.
Moreover, the complaint cites a 2018 analysis published by the United States National Institute for Health concluding that there exists no sufficient evidence that over-the-counter supplements can offer “cognitive protection” in adults with normal cognition. According to an Oregon State University researcher, most clinical trials that claim to demonstrate the effectiveness of over-the-counter supplements use “flawed methodology,” leading to conclusions that have “little scientific meaning, even less accuracy and often defy a wealth of other evidence,” the suit relays.
Per the case, false advertising of over-the-counter supplements has become such an “epidemic” that the United States Senate Subcommittee on Consumer Protection, Product Safety, and Insurance held a hearing in June 2014 to address the issue. During the hearing, Senator and Committee Chair Claire McCaskill argued that “scam artists and fraudsters” abuse the over-the-counter supplement market to “make a quick buck,” the filing says.
Similarly, the complaint contends that Nordic Naturals has profited from the sale of its “falsely, deceptively, and unlawfully advertised Product to unwary consumers.”
The lawsuit looks to cover anyone within the United States who purchased Nordic Naturals’ Omega brain, focus and memory supplements for personal use during the applicable statute of limitations period.
