A proposed class action lawsuit claims that snack bars made by The Good Fat Co. Ltd. are misrepresented as healthy even though they contain high levels of saturated fat.
According to the 54-page case out of California, snacks sold under the Love Good Fats brand—including the Lemon Mousse, Mint Chocolate Chip, Peanut Butter Chocolatey, Chocolate Chip Cookie Dough, Coconut Chocolate Chip, White Chocolatey Strawberry, Cookies & Cream, and Salted Caramel varieties—contain “dangerous levels” of saturated fat, which the suit stresses has been linked to an increased risk of cardiovascular disease and other health problems.
The lawsuit contends that the defendant’s perpetuation of the “myth” that its products contain “good” fats has misled consumers into believing the snacks are healthy and caused them to pay more for the items than they otherwise would have.
“Plaintiffs and the Class Members paid for Products that were purported to consist of healthy ‘good’ fats but received Products that consisted of dangerously high levels of saturated fat,” the complaint states. “The products Plaintiffs and the Class Members received were worth less than the products for which they paid.”
The case says that although the Love Good Fats products prominently feature the message that the snacks contain “good” fats and are therefore healthier than alternatives, these representations are false and misleading given the items’ saturated fat content. According to the suit, each Love Good Fats product contains between six and eight grams of saturated fat.
“For example, the Lemon Mousse and the Mint Chocolate Chip flavors contain 7 grams of saturated fat which is more than the amount of saturated fat in two large orders of McDonald’s fries,” the complaint reads. “Similarly, the Peanut Butter Chocolatey flavors contains 7 grams of saturated fat which is more than the amount of saturated fat in a slice of Pizza Hut’s Pepperoni Lover pizza.”
The lawsuit notes that the link between the consumption of saturated fat and coronary heart disease has been “well established and accepted in the scientific community.” Per the suit, reasonable consumers would not expect products marketed as healthy to contain such unhealthy levels of saturated fats.
The case alleges the defendant has violated several food labeling regulations under which a food is considered misbranded if its labeling is “false or misleading in any particular.” Moreover, the product labels make unauthorized nutrient content claims and omit required information about the foods’ saturated fat content, the lawsuit contends.
The case looks to represent anyone who purchased The Good Fat’s products in the U.S. within the applicable statute of limitations period.
