The 15-page lawsuit was filed after the company recalled more than 541,000 snow tires last month, which were labeled with the three-peak mountain snowflake symbol to signify compliance with North American snow traction safety standards.
According to the class action suit, the recalled products include the following tire models sold between August 24, 2020 and December 7, 2024:
- Fortune Tormenta R/T FSR309;
- Fortune Tormenta M/T FSR310;
- Prinx HiCountry R/T HR1; and
- Prinx HiCountry M/T HM1.
Despite featuring the snowflake symbol, the tires have reportedly failed to meet the required snow traction performance standards, exposing drivers to an increased risk of accidents and injuries in winter conditions, the case claims.
The company has failed to provide an adequate remedy for the apparent defect, the complaint alleges, arguing that the recall does not fully address the harm caused by the “excessively dangerous” tire design.
In addition, the filing contends that the manufacturer misled consumers into believing the recalled tires met safety standards and were free from defects. Consumers would not have purchased the tires at issue had they known they were unsuitable for winter conditions, the suit asserts.
The Prinx tire recall lawsuit looks to represent anyone in the United States who purchased or leased any tire models listed on this page at any time between August 24, 2020 and December 7, 2024.
