Class Action Lawsuit Claims ‘Free Shipping’ Promotions on Rejuvenation.com Are Falsely Advertised

The 10-page fraud lawsuit was filed by a Montana consumer who says he bought a laundry hamper on Rejuvenation.com earlier this year after seeing the company was offering “free shipping site-wide” to customers who applied a promo code during checkout. However, the plaintiff claims, Rejuvenation still displayed a $159 shipping fee after he added the item to his shopping cart and entered the code as instructed.
According to the case, the plaintiff got in touch with a Rejuvenation customer representative, who informed the man that he did, in fact, qualify for the promotion and that he should first go through with the purchase and then contact their business line to receive a refund for the shipping fee.
Relying on this assurance, the plaintiff completed his purchase and subsequently contacted the defendants’ business line only to be transferred multiple times between representatives, the Rejuvenation lawsuit says.
“He was finally informed that the initial customer service representative had made a mistake and that the item was not eligible for free shipping due to its weight—a restriction that was not disclosed on the product page or any easily accessible section of the website,” the complaint shares.
Per the case, the plaintiff reviewed the defendants’ “exclusions” webpage and found no mention of any exclusions for heavy items.
The filing alleges that Rejuvenation intentionally misrepresents that its free shipping promotion is sitewide as a “deliberate scheme” to deceive customers.
“As a direct result of [the defendants’] conduct, [the plaintiff] and other consumers have suffered economic damages and emotional distress, as they were induced to make purchases under false pretenses and had their complaints and requests for rectification disregarded,” the case contends.
The lawsuit looks to represent anyone in California who, within the last four years, purchased products from Rejuvenation under the representation of “free shipping site-wide” and was subsequently charged for shipping.
