Class Action Lawsuit Alleges RevitaLash, RevitaBrow Serums Can Cause Undisclosed Side Effects

A class action alleges the maker of RevitaLash and RevitaBrow serums has failed to warn consumers about the dangerous side effects associated with the products’ active ingredient.

According to the 39-page lawsuit, the beauty products contain dechloro dihydroxy difluoro ethylcloprostenolamide (DDDE), which belongs to a class of chemicals found in prescription drugs designed to promote eyebrow and eyelash growth. However, unlike these prescription medications, RevitaLash and RevitaBrow serums are available over the counter and do not come with necessary disclosures about their potential association with certain adverse side effects, the complaint contends.
The suit notes that DDDE is known to cause blepharitis, meibomian gland dysfunction, chronic dry eye, redness, discoloration, pain or irritation and other eye-related conditions. The chemical can also result in excess hair growth in areas outside the treatment area, such as on the cheek, or cause clumps of hair, brows and lashes to completely fall out, the filing says.
For these reasons, the FDA has warned that lash products containing DDDE are not safe for use and are unauthorized except under supervision of a medical professional, the case says.
Per the lawsuit, Athena has failed to obtain FDA approval for its serums—which include RevitaLash Advanced Eye Serum, RevitaBrow Advanced Serum, RevitaLash Advanced Pro, and RevitaLash Advanced Sensitive—and continues to sell the products over the counter to consumers while touting their safety.
“Athena continues to deceptively and fraudulently market its Enhancement Serums as beauty products, misleadingly suggesting the Enhancement Serums are merely natural products that ‘enhance’ appearance only without any effect on the human body (viz., hair, lash, or brows),” the case says. “This is untrue because the Enhancement Serums contain a substance known to stimulate hair, lash, and brow growth, which also carries substantial health risks that Athena did not and does not disclose.”
The complaint says the plaintiff, a New York resident, is one of many customers who purchased the RevitaBrow and RevitaLash serums without knowing that using the products could subject them to adverse side effects. The plaintiff claims she would not have bought the products, or would have paid substantially less for them, had she known the truth.
The Athena lawsuit looks to represent anyone in the United States or its territories who bought the RevitaLash or RevitaBrow serums for personal, family or household purposes within the applicable statute of limitations period.
